1. Acceptance of Terms
Welcome to Marbev ("Marbev," "we," "our," or "us").
By accessing our website, submitting an order, purchasing a digital business card, or using any services provided by Marbev, you agree to be bound by these Terms of Service and Conditions ("Terms").
If you do not agree with these Terms, you should not use our website or services.
2. Description of Services
Marbev provides digital business card solutions, including the creation, publication, hosting, maintenance, and related support services for digital business card micro-websites.
The features, functionality, hosting, and ongoing services provided with each digital business card may vary depending on the subscription plan or service purchased.
3. Eligibility
By using our services, you represent and warrant that:
- You are at least 18 years of age.
- You have the legal authority to enter into binding agreements.
- All information you provide is accurate and complete.
4. Orders, Payment and Subscription
All orders require full payment before work begins unless otherwise agreed in writing.
Digital business cards are provided on an annual subscription basis. Subscription fees are payable in advance and must remain current to maintain hosting and related services.
Marbev reserves the right to refuse or cancel any order at its sole discretion, including where inaccurate information has been provided or where requested content may violate applicable laws or third-party rights.
5. Customer Responsibilities
The customer is responsible for providing accurate, complete, and lawful information for inclusion in the digital business card.
The customer agrees that all submitted information, photographs, logos, trademarks, social media links, website links, and other materials:
- Are owned by the customer or used with proper authorization.
- Do not infringe upon any intellectual property rights.
- Do not violate privacy, publicity, or other legal rights of any person or entity.
- Do not contain unlawful, defamatory, misleading, fraudulent, offensive, or harmful content.
The customer assumes full responsibility for the content submitted to Marbev.
6. Authorization to Publish Submitted Information
By submitting information and content to Marbev, the customer grants Marbev permission to use, reproduce, store, process, display, and publish such content as necessary to create, host, maintain, and provide the digital business card service.
The customer acknowledges that information submitted for inclusion in the digital business card is intended to be publicly accessible to individuals who visit the digital business card.
7. Review and Approval Process
Customers will be provided an opportunity to review their digital business card prior to final publication.
Once approval is provided, the project shall be deemed accepted and completed.
Marbev shall not be responsible for errors that were present and approved during the customer review process.
8. Intellectual Property
Customers retain ownership of the content they provide to Marbev.
All software, designs, templates, systems, code, processes, branding, technology, and proprietary materials developed or utilized by Marbev remain the exclusive property of Marbev unless otherwise agreed in writing.
Nothing in these Terms transfers ownership of Marbev's intellectual property to the customer.
9. Hosting and Subscription Services
Digital business cards are provided under an annual subscription plan unless otherwise stated.
The annual subscription includes hosting of the customer's digital business card together with any services expressly included in the selected subscription plan.
Hosting is provided only while the applicable subscription remains active and paid in full.
Marbev reserves the right to modify, migrate, suspend, transfer, or discontinue its hosting services where necessary due to business, technical, legal, operational, financial, or security considerations.
Where reasonably practicable, Marbev will provide advance notice of any planned changes that materially affect hosting services.
10. Subscription Renewals and Cancellation
Subscriptions renew annually on the anniversary of the customer's original subscription date.
Customers who pay by credit or debit card authorize Marbev to automatically charge the payment method on file for the applicable annual subscription fee on or after the renewal date, unless the subscription has been cancelled before renewal.
Customers who pay by cash or bank transfer will be issued an invoice approximately thirty (30) days before their renewal date. Payment must be received on or before the renewal date to avoid interruption of service.
A seven (7) day grace period will apply following the renewal date. During this grace period, Marbev may continue to host the customer's digital business card while awaiting payment.
If payment is not received by the end of the grace period, Marbev may suspend or deactivate the digital business card without further notice.
Digital business cards that remain unpaid after the grace period may be scheduled for permanent deletion from Marbev's systems. Once deleted, Marbev is under no obligation to restore the digital business card or any associated content.
Customers may cancel their subscription at any time. Cancellation will prevent future renewals but does not entitle the customer to a refund for any unused portion of the current subscription period unless otherwise required by applicable law or stated in Marbev's Refund Policy.
Subscription Pricing
Marbev reserves the right to revise its subscription fees from time to time. Any change in subscription pricing will apply only to future renewal terms and will not affect the current subscription period.
Customers will be provided with at least thirty (30) days' advance notice of any change to the applicable subscription fee before the renewal date. Continued use of the service following renewal constitutes acceptance of the revised subscription fee.
11. Service Availability
Marbev will use commercially reasonable efforts to maintain service availability.
However, we do not guarantee uninterrupted, error-free, or continuous availability.
Temporary interruptions may occur due to:
- Scheduled maintenance
- Software updates
- Hosting provider issues
- Internet outages
- Security incidents
- Force majeure events
- Circumstances beyond our reasonable control
12. Prohibited Uses
Customers may not use Marbev's services to publish, distribute, promote, or facilitate:
- Illegal activities
- Fraudulent schemes
- Malware or malicious software
- Harassment or abuse
- Hate speech
- Defamatory content
- Intellectual property infringement
- Spam or unsolicited communications
- Any content prohibited by applicable law
Marbev reserves the right to remove, suspend, or disable content that violates these Terms.
13. Warranty and Refund Policy
Use of Marbev's services is subject to our Warranty and Refund Policy, which forms part of these Terms.
Customers should review that policy before placing an order.
14. Privacy Policy
Use of our website and services is also governed by our Privacy Policy.
By using our services, customers acknowledge that they have reviewed and accepted our Privacy Policy.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Marbev's total liability arising from any claim related to our services shall not exceed the amount paid by the customer for the specific service giving rise to the claim during the then-current subscription term.
Marbev shall not be liable for any:
- Loss of profits
- Loss of revenue
- Loss of business opportunities
- Loss of data
- Indirect damages
- Consequential damages
- Special damages
- Incidental damages
arising from the use of, inability to use, interruption of, suspension of, or discontinuation of our services.
16. Indemnification
The customer agrees to indemnify, defend, and hold harmless Marbev, its owners, employees, contractors, and representatives from any claims, liabilities, damages, losses, costs, or expenses arising from:
- Customer-provided content
- Violation of these Terms
- Violation of applicable laws
- Infringement of third-party rights
17. Termination
Marbev reserves the right to suspend or terminate services at any time if:
- The customer violates these Terms.
- The customer provides unlawful or prohibited content.
- Required subscription fees remain unpaid.
- Continued service would expose Marbev to legal, security, financial, or operational risks.
Termination under this section does not relieve the customer of any outstanding payment obligations.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Trinidad and Tobago.
Any disputes arising from these Terms or the use of Marbev's services shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.
19. Changes to These Terms
Marbev may modify these Terms from time to time.
Updated versions will be posted on our website with a revised Effective Date.
Continued use of our services following publication of the revised Terms constitutes acceptance of the updated Terms.
